The Dubai Court of First Instance heard that M.H., 25, attacked A.F., his 31-year-old Syrian colleague, without warning and punched and kicked him for parking in an inappropriate manner.
The court convicted the accused of assault and causing permanent disability in A.F.'s right leg. M.H. pleaded not guilty and claimed he did not have any intention to cause permanent disability to his co-worker.
Presiding Judge Al Saeed Mohammad Barghout suspended the imprisonment for three years, during which time the crime should not be repeated. He also dismissed A.F.'s civil compensation claim because he failed to pay the applicable fees.
Records show the case was referred to court following 20 months of investigations. Prosecutors said the defendant and another suspect [who remains at large] beat up A.F. and caused him disability.
A.F. claimed the incident happened around 8pm when he asked M.H. to move his bus from a parking lot.
"We both work for the same company in Al Muhaisna. I could not move my car because M.H.'s bus blocked the way. I went to ask him to move his bus away because the space was very narrow," A.F. said.
"He refused and said ‘park properly next time'. We had a heated argument which led to a fight… we pushed each other. Our colleagues stopped the fight and we went to the supervisor to solve the matter."
The Syrian testified that M.H. and the runaway attacked him from behind when they left the supervisor's desk. "M.H. and the other suspect punched me and I fell. They continued to beat and kick me," A.F. testified.
The judgment can be appealed within 15 days.
